Unite HERE, a union representing 100,000 casino workers, sent a letter Wednesday to the state’s Gaming Facility Location Board alleging there are labor problems with the developer proposing a casino in Schenectady.

The New York City-based union says there are ongoing and active labor disputes at Rush Street Gaming’s three casinos in Pittsburgh, Philadelphia and Des Plaines, Illinois. Here in New York, Rush Street already has labor agreements in place.

“The company has steadfastly resisted efforts by its workers at all three locations to win a fair process for organizing — the very same process to which all applicants in New York, by law, must adhere,” Chris Magoulas, assistant to union President D. Taylor, said in the letter.

According to the union, employees have been pursuing unionization since August 2011 at SugarHouse Casino in Philadelphia, April 2013 at Rivers Casino in Pittsburgh and October 2013 at Rivers Casino in Des Plaines.

Workers have also reported harassment by casino managers, including threats, surveillance and other forms of intimidation, the letter states. Although the casinos have settled the charges, Unite HERE says the labor dispute continues.

“When you settle labor charges, you don’t settle the underlying dispute,” said Marty Leary, gaming research director for Unite HERE. “It is completely bogus to say everything is hunky dory. The disputes have been active and ongoing for years.”

For the proposed Schenectady casino, Rush Street has reached a labor peace agreement with the New York Hotel and Motel Trades Council and a memorandum of understanding for a project labor agreement with the Greater Capital Region Building and Construction Trades.

Rush Street Chairman Neil Bluhm and CEO Greg Carlin are partnering with the Galesi Group to pitch a $330 million casino project in Schenectady. Bluhm and Carlin are also working with James Featherstonhaugh, minority owner of Saratoga Casino and Raceway, on a casino proposal in Newburgh, Orange County.

Leary said Unite HERE decided to send a letter to the gaming board about the labor disputes after watching Rush Street’s presentation on the proposed Schenectady casino Monday.

“The only reason we sent it is because we saw statements that Rush Street made about winning awards and that all of the charges have been settled,” Leary said.

“I can’t predict whether they would honor New York’s labor peace agreement, but the fact that they have resisted so vigorously at all of their other properties to me is relevant information for the siting board to consider.”

After the casino presentation Monday, Carlin said Rush Street’s track record speaks for itself. The SugarHouse casino has been ranked in the top three for best places to work for four years running by the Philadelphia Business Journal and one of Philadelphia’s top 20 workplaces for three years running by the Philadelphia Inquirer and Daily News.

The Rivers Casino in Pittsburgh was named best overall gaming resort in Pennsylvania four years running by Casino Player Magazine, best overall casino in Pennsylvania four years running by Strictly Slots Magazine and one of Pittsburgh’s best places to work this year by the Pittsburgh Business Times.

The Chicago Reader recognized the Rivers Casino in Des Plaines as best casino for three years running, and the Chicago Tribune named the casino one of Chicago’s top 20 workplaces in 2012 and 2013.

“I am very proud of our culture, and every one of our properties has received best-places-to-work awards,” Carlin said.

He added that the union withdrew 70 percent of the charges against Rush Street’s casinos and the National Labor Relations Board “has never found Rush Street Gaming to be in violation of the act.”

Jack Shea, president of the Allegheny County Labor Council, AFL-CIO, said it has been a struggle for workers to form a union in Pittsburgh because of pushback from the company.

“It has been about a year that they have been trying to form their union,” he said. “They haven’t been successful yet, but they will be because they are very determined.”

Shea said Rush Street is blocking their efforts by “scaring and intimidating” workers, who are afraid of losing their jobs. He said the company is also pulling “stunts” to avoid unionization.

But Shea said what’s happening in Pittsburgh shouldn’t reflect poorly on Rush Street in Schenectady. He compared Pittsburgh to Schenectady, pointing to similarities with struggling schools and high poverty. Shea said he believes a casino in Schenectady would be positive for the city and provide residents with job opportunities.

“I actually think it would be a great thing for a casino to go to Schenectady,” he said. “If they want to form a union there, they will form a union. The Rivers Casino is very nice; I go there quite often. It’s a nice atmosphere and a first-class facility.”
